Start with the law here, not the numbers. Any paid stay under 28 consecutive days needs a hotel or guesthouse license, and owners of unlicensed flats can be prosecuted. For most residential owners, the legal option is a furnished let of 28 days or more.

Rules

As of 2026-10-19

  • Stays under 28 consecutive days need a hotel or guesthouse license from the Office of the Licensing Authority (OLA) before you open.
  • Without a license, every letting must be at least 28 continuous days, with no refund or fee cut if a guest leaves early.
  • Owners and tenants of unlicensed premises can be charged: up to HK$500,000 and 3 years' imprisonment, plus HK$20,000 a day for continuing offenses.
  • License applications need a lawyer's written advice that the deed of mutual covenant or government lease doesn't prohibit guesthouse use, plus building and fire safety compliance.
  • The OLA has a dedicated team searching websites, apps and social media for unlicensed guesthouses, and runs surprise inspections around holidays.
