Airbnb rules & returns in Hanoi

Hanoi follows Vietnam's national rules, and they tightened in 2026. Using a residential condo apartment for nightly guests can now bring fines of VND 100–130 million. The legal route is a house, or a unit approved for tourist accommodation, registered with the authorities.

As of 2026-10-19
- Decree 339/2026/ND-CP (in force 26 Aug 2026) fines VND 100–130 million for using a condominium apartment for non-residential purposes, except renting it out as a home.
- Lawyers say rotating nightly guests booked through platforms, with check-in and check-out, looks like tourist accommodation rather than renting a home. Registering for tax doesn't make a residential-only unit legal.
- Legal hosting means a house, or an apartment approved as tourist accommodation, with business registration, a security-and-order certificate and notice to the provincial tourism authority (Law on Tourism 2017).
- Declare guests for temporary residence with local police the same day.
